LOS ANGELES — Halle Berry is getting a divorce… for the third time. The Emmy Award-winning actress filed her divorce petition on Monday. Her estranged husband — Olivier Martinez — filed his paperwork on Tuesday and his attorney, Laura Wasser, listed him as the petitioner. Meaning? Halle and Olivier are now fighting over who’s divorcing who. Crazy stuff, huh? Olivier is asking the court for joint custody of their 2-year-old son (Maceo). But he won’t get a dime of her money because there’s a prenup in place.

Halle, 49, and Olivier, 49, have been at each other’s throats as of late. He claims she’s “very difficult” to get along with and “goes nuts when she doesn’t get her way.” Conversely, Halle is sick and tired of Olivier’s bad temper… saying he’s primarily responsible for all the bad press she gets.
Halle was married to baseball star David Justice from 1992-1997.
She divorced singer Eric Benét in 2005 after 4 years of marriage.
